These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Dmytro Lytvynenko, the owner and operator of the PuffTrack mobile application ("PuffTrack", "we", "us", or "our"). By downloading, installing, accessing, or using PuffTrack you accept and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download, install, or use PuffTrack.
PuffTrack is intended for individuals 17 years of age or older. By using PuffTrack you warrant that you meet this age requirement and are legally capable of entering into this agreement. If you are under 17 or otherwise unable to agree to these Terms, you must not use PuffTrack.
PuffTrack provides self‑help tools designed to help Users monitor and gradually reduce nicotine or cigarette consumption. PuffTrack is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your health or quitting strategy. Reliance on any information provided by PuffTrack is solely at your own risk.
Subject to your compliance with these Terms, we grant you a personal, revocable, non‑exclusive, non‑transferable, limited license to install and use PuffTrack on devices that you own or control, solely for your personal, non‑commercial use. We reserve all rights not expressly granted herein.
Auto‑Renewing Subscription. PuffTrack currently offers auto-renewing subscriptions for accessing the app, which are billed via Apple’s App Store. The subscription, pricing, billing cycle, and trial periods (if any) are displayed in‑app prior to purchase.
Trial Periods. Some subscription services offered on the App may include a free-trial period, allowing you to access premium features for a limited time. You may cancel a free-trial subscription at any time through the subscription settings in your iTunes account. To avoid charges, cancel the subscription before the trial period ends.
Payment Processing. All payments are processed by Apple. We do not collect or store your payment information.
Renewal & Cancellation. Your subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID account settings.
Refunds. Refund requests are handled by Apple under its refund policies. We have no authority to issue refunds for purchases made through the App Store.
You agree not to:
PuffTrack, including all software, content, trademarks, logos, and other proprietary materials, is owned by or licensed to Dmytro Lytvynenko and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any ownership rights in PuffTrack.
Your use of PuffTrack is also governed by our Privacy Policy, which explains how we collect, use, and share your personal data. By using PuffTrack you consent to the collection and processing of your data as described therein.
We may modify, suspend, or discontinue PuffTrack (in whole or in part) at any time with or without notice. We may also modify these Terms; the "Last updated" date will change accordingly. Your continued use of PuffTrack after changes take effect constitutes acceptance of the updated Terms.
We may terminate or suspend your access to PuffTrack immediately, without prior notice, if we believe you have violated these Terms. Upon termination, the license granted to you will cease and you must delete all copies of PuffTrack.
PuffTrack is provided “as is” and “as available.” We make no representations or warranties of any kind, express or implied, regarding PuffTrack, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non‑infringement.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, resulting from (a) your use of or inability to use PuffTrack; (b) any conduct or content of any third party; or (c) unauthorised access, use, or alteration of your data.
You agree to indemnify and hold harmless Dmytro Lytvynenko and his affiliates, officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including legal fees) arising out of or related to your breach of these Terms or your misuse of PuffTrack.
These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict‑of‑law rules. You agree to submit to the exclusive jurisdiction of the courts located in Kyiv, Ukraine to resolve any legal matter arising from these Terms or your use of PuffTrack. Alternative dispute‑resolution mechanisms (e.g., informal negotiation or binding arbitration) may apply if required by local law.
If any provision of these Terms is found invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a present or future waiver of such provision nor limit our right to enforce such provision at a later time.
These Terms, together with the Privacy Policy and any supplementary terms provided in‑app, constitute the entire agreement between you and us regarding PuffTrack and supersede all prior agreements.
